Parties

This document forms a legally binding agreement between you, a person who decides to join www.mysingleclub.com, an online dating service formed under the law of State of California. The term "the club" will be used to refer to www.mysingleclub.com.

Term

The agreement shall begin when you use the services presented on the web site affiliated to the club. Using the service constitutes acceptance of these Terms of Use. If you do not agree to the Terms of Use, you will not be able to register as a member of the club.

Changes in Terms of Use

These Terms of Use are subject to change at any time. Your continued use of the service constitutes your acceptance of the new Terms of Use. Notice will be given by updates to the web site, by email or by other means.

Copyright

The web site, the database of membership and any other items or content on the web site are the property of the club and may not be duplicated without prior permission of the club.

Profiles

To become a member, you must first register with the club. If you register, you agree to abide by the following rules:

• Messages or profiles should not contain sexual or suggestive language;
• Messages or profiles should not encourage illegal activities;
• Members must be at least eighteen years old;
• Messages, profiles or photographs must not infringe intellectual property rights (copyright, trade secret, trademark or patent);
• Messages, profiles or photographs must not contain unlawful content;
• Messages or profiles must be accurate and honest;
• Members must not send similar messages to many members (a.k.a. spamming);
• Messages or profiles must not invite or promote any commercial activity;
• Members must not send a message to a member more than three times in twenty four hours when there has been no reply. Such behavior is considered harassment;
• Members must not behave in an anti-social, racist or offensive manner;
• Members must not behave in a way that might cause distress or might provoke complaints from other members;
• Members must not allow others to use their account;
• Members must not impersonate someone else;
• Members must not express or imply that any statements made are endorsed by the club without our prior written permission;
• The club reserves the right to refuse or remove membership from anyone for breach of these rules. Whether a member has broken these rules or not is at the sole discretion of the club, which reserve the right to decide what action to take. The club also reserves the right to alter or tailor your profiles to comply with these rules.

Photos

The club reserves the right to review and refuse any photographs for any reason. We are not obliged to give a reason.

Profiles

The club cannot guarantee the accuracy of any member's profile. It is the member's responsibility to check the accuracy of any information given by yourself and another member.

Events

The club is not responsible for any personal injury or property damage for the members and their guests at the events.

Refund

Fees are fully refundable when the event is canceled, or you cancel your registration 24 hours prior to the response deadline of the particular event.

Suspension or Removal of Service

The club reserves the right to suspend or remove your membership at any time without any notice on the ground that you breach the rules stipulated herein at our discretion. We are not obliged to give a reason.

Privacy Statement

This is a complete statement of the information we collect and how we use it.

If you become a member, you will need to give us the following information:

• A member ID and password;
• Your agreement that you have read and will follow our Terms of Use;
• An e-mail address;
• Other relevant personal information to portray yourself completely.

Your e-mail address will be used to convey important information about your membership (such as when you have received a message from another member) and may be used to send occasional notices about our services, such as parties and social gatherings that you might be interested in.

The other personal information will be used to create a profile that will be visible to members.

Each member’s personal information and email address will only be used in this web site. We will not use it for any other purpose and we will not sell any information to another party.

Any data you submit to the club (such as your profiles and messages) will be protected to the best of our ability. Due to the nature of the Internet, however, the club cannot guarantee against security breaches.

The club and its staff members reserve the right to look at submitted information (such as profiles and messages) to ensure that our Terms of Use are being complied with.

Paid Services

Membership is free.

Right to cancel

Members may cancel at any time by sending an email to notify the system administrator.

Disclaimer

The web site may contain links to other web sites. We cannot endorse these web sites and as such you acknowledge that we cannot be held responsible for the content of these web sites.

We cannot guarantee that every member is over eighteen years old nor do we accept liability or responsibility for any content, use or access of the website by persons under the age of eighteen.

You agree to indemnify, defend and hold harmless the club, its staff members, representatives and affiliates from your use of the service, including any violation of these Terms of Use or any accusation that the information that you supply to the club infringes the intellectual property rights of any third party or such information disparages, libels or invades the privacy of any third party. In addition, the club disclaims all liability for the acts of other members or users of the service (including hackers).

Warranty

The club provides this service 'as-is' without warranty of any kind for a particular purpose. These terms extend to any third parties. Because of the nature of the Internet and information technology, the club does not offer any guarantee of continuous and uninterrupted service.

Jurisdiction

This agreement is entered into in the State of California, the United States of America, and shall be governed by, and shall be construed in accordance with law of the State of California. The courts of the State of California shall have jurisdiction to hear and determine any cost, action or proceedings, and to settle any disputes that may arise out of, or in connection with, these Terms of Use. You irrevocably submit to the jurisdiction of such courts.
